Civil Court can enforce the decision of the arbitration regarding Hilton case : High Court

High Court has issued a verdict saying that the Civil Court can enforce the decision of the arbitration regarding the Hilton case.

High Court made this verdict regarding the termination of the contract made by MDA Leader Ahmed Siyam’s Irufushi with Hilton Group. The case has been going on in Singapore arbitration since 2013. The arbitration ruled that Sun Travel terminated the agreement against the terms of the contract and hence, they should pay 24 million dollars as compensation to Hilton Group.

When Hilton filed the case to the Civil Court asking to enforce the arbitration ruling, Civil Court stated that it is not in the Civil Court’s jurisdiction. High Court’s verdict states that since the arbitration legislation states that arbitration rulings would be enforced by the relevant courts in Maldives, and that the Civil Court is the relevant court in this case. In addition the verdict states that the procedure made by the high court regarding the implementation of arbitration also shows that the relevant court in this case is the civil court.
