Lawyer Shameem raised concerns Why the person who shut down the SC GEMS is not held accountable for.
Similar to the case of the person who assisted in preparing a bomb in an attempt to blow up the Presidential Launch was not held accountable for, it is alarming that the person who shut down the GEMS was not held accountable for.
If anyone acts upon and unlawful order, it is the person himself or herself who should be held accountable for the particular action and the person who ordered should be accountable for the unlawful order.
GEMS can only be operated and accessed by personnel who has the password access and if a staff member allegedly shut it down, NCIT is capable of identifying who,how and when it was done.
If GEMS was allegedly shut down by a staff member of SC, that person is to be held accountable for and not the person who ordered to do so. "'I am clueless of how the Criminal Procedure Code was applied by the CC on someone alleged on a criminal offence. The Code specifies each and every step very clearly'', Shameem said.
Shameem further stated that leaving Maldives aside, when looking at Law Books across the world, all those books also clearly defines that the perpetrator has to take full responsibility of committing the crime. However it is a big issue that the justices in Maldives are not following those.
