The Friday sermon has stated that it is the plaintiff who has to prove his allegations regarding the defendant.
“O Muslims! In a trial that which distinguishes truth from falsehood is the evidence and proofs. All accusations have to be proved. Without any evidences a claim cannot be proved. The Qur’an says which means, ‘’Produce your proof if ye are truthful.’”
About ten scholars was asked regarding the meaning of this statement from the sermon whether it is the plaintiff or the defendant who has the burden of proof. All of the scholars agreed that it is the plaintiff who has the burden of proof and the defendant is innocent until proven guilty.
The recent verdict upon Former Defence Minister Colonel Mohamed Nazim seems to have followed something that has more authority than the Quran and Sunnah. Many analysts say that the verdict baffles the mind as no enough proofs were presented by the plaintiff.
During the Friday sermon, the Imam said that no guilty verdict can be issued upon the defendant while the plaintiff fails to provide evidences.
