Hulhumale’ Magistrate Court has decreed that the decision taken by HDC to revoke the plot of land in Hulhumale’ to Villa Hakatha was illegal.
The ruling issued by the Court said that the decision made by HDC on 1st August 2005 to annul the contract between HDC and Villa was against the terms of the initial agreement.
The ruling also stated that the letter sent by HDC notifying Villa of the decision was not according to legal or judicial means and ordered HDC to follow the initial agreement.
The Magistrate Court ruling also said that as the HDC decision was nullified Villa Hakatha can now apply a separate suit to seek compensation for any damages caused due to the decision.
