The appeal hearings for Hussain Humam, suspected of having murdered the late Parliamentarian Dr. Afrasheem Ali, has been concluded.
In today’s hearing Humam had responded to the statements made by state lawyers.
Humam noted that he had confessed under duress and intimidation by the Police and that the case the family had filed over the intimidation had not been reviewed. The lawyer also noted that the doctor had recommended that Humam undergo a psychological checkup and that it had not been carried out.
The lawyer also said that while the state lawyers had said that Humam’s confession cannot be retracted, they had not been able to prove their case on this argument. He also said that Police forensic test cannot be accepted without an independent review. He also said that while Police said that Afrasheem’s DNA was found in Humam’s clothing but it cannot be accepted as the confession was taken under duress.
In the hearing Humam said the Prophet had decreed that unjust verdicts issued by Judges against Islamic Shariah will be reviewed by God and the unjust will be punished accordingly. He also said that Sheikh Albany had decreed that a crime cannot be proven unless the statement of two witnesses was given or the criminal confessed to the crime.
In today's hearing, the court had announced that the hearings of the case and that in the next hearing the verdict will be passed. Humam was given the death sentence in Criminal Court on January 16, 2014. When the appeal was filed in High Court, the Court supported the lower Court's sentence. That hearing was held on September 7 last year.
