The late Dr. Afrasheem’s next of kin has sent a letter to Supreme Court stating that they do not want to implement the death penalty of the murder on Hussain Humam until the investigation is fully completed.
The letter sent by Afrasheem’s father Ali Zafir and brother Abdu Nasir said that though the police had claimed that someone had paid Humam to orchestrate the murder, they had not been able to find out who had paid the money. Given the circumstance, the next of kin said that they did not wish to implement the death penalty.
Supreme Court had refused to accept the letter, stating that it must be sent on official hours. However, his family had said that they had faxed the letter.
Under Islamic Sharia, death penalty can be implemented once the next of kin of the murder wished to implement the death penalty. Once all legal avenues had been completed, the next of kin has to be considered when implementing the sentence.
The late Parliamentarian was murdered between 11.30pm and 2.00am on October 1,2012 in the stairwell of his residence.
Humam was declared guilty over the murder charges on January 16, 2014 in Criminal Court. The case had been filed for appeal in both High Court and Supreme Court.
Once Supreme Court passes their verdict, the state will have a 30-day period to implement the death penalty.
