Do not believe that Qasim’s case can be charged again : Hisaan

Qasim Ibrahim’s lawyer Hisaan Hussein have said that he does not believe that Qasim Ibrahim can be charged again.

Speaking to the press Hisaan said that under the new criminal procedures act PG can only recall a case before the preliminary hearing and before the first hearing of the case. “They do not have the authority to recall a case in any other circumstances. This is the fifth hearing of the case. Hence I do not believe that they can file it again or continue it. The constitution does not allow it. I do not believe the state can charge Qasim again.

Hisaan said that the state fled from the court tonight and she is concerned about it. She said that the PG should take lead in upholding the criminal justice system. “ Hence people in such posts disrespects the court and trying to hijack the justice system is worrisome” said Hisaan.

In addition Hisaan said that the article 115 of criminal procedures act states that if the evidence presented does not fit a certain civil criteria the whole case can be invalidated. “We have been saying that the state did not submit any evidence in this case. They presented something Qasim said in a political platform. Hence it cannot be considered as evidence that can be used to prove the case against Qasim.

Former Assistant PG Shameem said that in the 14 years he spent in AG office and PG office no lawyer ever failed to turn up to the hearing of the court. He said that hence he is concerned that the lawyers did not turn up for Qasim’s hearing.

Spokesperson of PG Office said that the court annulled the case during a time when they have requested to delay the hearing for sometime tomorrow. The court states that they annulled the case because the lawyers from PG office failed to turn up to the court after they called them several times.
