Qasim Ibrhaim’s lawyers have stated that the ongoing police investigation on Qasim is being conducted with a preconceived notion to convict him.
Speaking to the press today, Hisaan Hussain a member of Qasim’s legal team said that the investigation is not based on a crime that is mentioned in the constitution. She said that he is being suspected of non-existent crimes. Hisaan said that based on how the investigation is being conducted they believe that the purpose of the investigation is to achieve political goals. Hisan said that, right to remain silent is a constitutional right and it can be limited through the constitution only. She said that this right cannot be violated through a court order.
“However, when Qasim used his right to remain silent they showed a court order saying that he should speak. Later they said that if he does not cooperate with the police they will charge him for obstructing the police” said Hisaan.
Hisaan said that this proves that the investigation is well planned and is being conducted to convict Qasim for a crime. “We believe that they are trying to find something to convict him of” said Qasim.
Lawyer Muhammad Waheed said that the investigating officers will also know that they are acting unconstitutionally. He said that even though these acts cannot be investigated today, there will be a day where it will be investigated. Ahmed Shafeeg another member of Qasim’s legal team said that limiting the number of lawyers that can be present with Qasim during the questioning is also unconstitutional.
Hisan said that speaking at the rally Qasim merely asked to support the opposition and that it is not a crime. “If it is a crime to ask to support the vote, then no one can call to support any vote” said Hisaan. In addition, she said that regarding the vote some people threatened parliament members and ordered to vote in a specific way. She said that these things are unlawful.
Former Deputy PG Shameem said that the case was sent even without completing the required procedures.
